ALERT!! Is BWSR Trying to Intimidate Counties? $500 Per Linear Foot Not In Compliance Is The Other Option?

BWSR is looking for comments on this proposed amendment to the Administrative Penalty Orders. The deadline to submit your comment is in 11 days.

Here’s part of the text in the draft rule amendment.
” An annual penalty will be assessed based on the total linear feet of riparian frontage on a parcel. The penalty will be due on day one of the 11th month after the noncompliance notice was issued. The penalty may be repeated at the discretion of the county or watershed district. The county or watershed district may select a specific penalty amount within the range shown for the corresponding linear feet of riparian frontage, or include the range in their official controls and select a penalty amount subject to the specific characteristics of each case.”

This appears to be the state of Minnesota attempting to strong-arm county governments who are choosing to maintain their land/water use authority under their jurisdiction.See BWSR’s comment page here and then click on the proposed amendment near the top of their page also found here.
